Terms of Use for Poser

These Terms cover the Poser mobile app: physical safety when attempting poses, your licence to use it, what happens to the photos on your device, and Premium bought through Apple.

1. Who We Are

Poser: Pose Camera is made by Concurrent Space Ltd, a company registered in England and Wales under company number 16800102.

By using Poser you accept these Terms. If you do not, please do not use the app.

Poser comes from the App Store, so Apple's Licensed Application End User Licence Agreement applies as well. Where these Terms are silent, that agreement fills the gap, and where they conflict with mandatory Apple terms, Apple's terms control.

2. Physical Safety

Poser overlays a reference image so you can see and try to match a pose. It does not assess your fitness, flexibility, balance, strength or health, and it does not provide medical advice, coaching, instruction or supervision.

Some poses involve stretching, balance, strength or positioning that can carry a risk of injury, particularly without a warm-up, without adequate physical capability, without clear space, or on unstable ground.

Do not attempt any pose that is beyond your physical ability, that causes pain, or that is unsafe given your health, surroundings or equipment. Stop immediately if you feel pain, dizziness or instability. If you have a medical condition or concern, speak to a qualified professional first.

You attempt poses at your own risk. Nothing in this section affects our liability for death or personal injury caused by our negligence, which cannot be excluded by law.

3. Your Licence

We give you a personal, non-exclusive, non-transferable licence to use Poser on devices you own or control, subject to Apple's Usage Rules.

Please do not resell it, reverse engineer it, or work around Premium limits. Poser itself, including its software, interface, design, branding, bundled graphics, frames, stickers and pose materials, stays ours or our licensors'.

4. Your Photos Live on Your Device

Poser has no cloud account. Captured photos, pose references, custom stickers, tags and editing data sit on your device and nowhere else. There is no Poser login and no server backup.

This means we cannot restore your library for you. If your device is lost, damaged or wiped, if you restore from an old backup, or if you delete the app, that content is gone and we have no copy of it.

Keeping a device backup, or exporting the images you want to keep, is the only thing that protects them.

5. Your Content

You keep ownership of the photos, pose references, stickers, decorated images and text you create or import. We claim no ownership of them.

You are responsible for having the rights and permissions you need, including permission to photograph people and the right to use images you select as pose references or sticker sources.

Do not use Poser to create or share content that is unlawful, infringes copyright or privacy rights, or harasses, exploits or unlawfully depicts anyone.

6. Premium and Subscriptions

Premium is sold through Apple in-app purchase as a monthly subscription, a yearly subscription, or a one-off lifetime purchase. The Apple purchase sheet shown before you confirm sets the product, price, billing period and renewal terms.

Apple handles payment, renewals, cancellations, billing problems and refunds, and we cannot issue App Store refunds ourselves. Deleting Poser does not cancel a subscription. Cancel it in your Apple ID settings.

Lifetime means the supported commercial life of Poser. It does not guarantee that every feature, provider, device or operating system version stays available indefinitely.

We may change features, free limits or Premium benefits in a future version. If Premium lapses, Premium features lock, but we will not delete photos, poses or stickers you have already created.

7. Privacy

Our Privacy Policy explains what stays on your device, the limited information handled by Apple, RevenueCat, Aptabase and Sentry, and the choices you have. It forms part of these Terms.

8. Support

Concurrent Space Ltd, not Apple, is responsible for providing any support and maintenance the law requires for Poser. Contact us at poser@concurrent.space.

9. Liability

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Your statutory rights under the Consumer Rights Act 2015 are unaffected.

Beyond that, we are not liable for indirect or consequential loss, and our total liability for any claim is limited to the amount you paid us for Poser in the twelve months before the claim arose.

10. Governing Law

These Terms are governed by the law of England and Wales. If you live elsewhere in the UK, or in the EU, you keep the protection of your local consumer law and may bring proceedings in your local courts.

11. Apple as Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce them against you as a third-party beneficiary.
